A New York State Supreme Court jury awarded James Collins $162,400 from Bethlehem Steel's subsidiary railroad, South Buffalo Railway. The jury found that between October 20, 1986 and April 5, 1989, the railway violated Federal Occupational Safety and Health Administration mandates on noise levels. The jury also found that Collins should have been afforded hearing protection and that hearing conservation procedures should have been implemented during that time. The case was brought pursuant to the Federal Employees' Liability Act (FELA), a federal statute that protects all railroad workers since they are not covered by any workers' compensation laws.
