Wojtowicz was a 37-year-old homemaker and mother of two boys who had felt a lump in her right thigh which she reported to her physician. Her physician referred her for x-rays which were misread by the hospital's radiologist. Wojtowicz went undiagnosed for about a year and, when the mass in her leg was finally removed, it was found to be angiosarcoma which is a cancer with a poor survival rate. Ballow argued to the jury that, had it been removed at the time the x-ray was taken, Wojtowicz would have had a 90% chance of survival.
