A 42-year-old man while operating a backhoe across the Grand Island Bridge was struck from the rear by a tractor trailer. Our client suffered a fracture of his right elbow, causing him to undergo surgery. Defendant, U.S. Bulk Transport, Inc. tried to argue that because Fike had no slow-moving triangle on the back of his backhoe, the driver of the tractor trailer was unable to see and stop his vehicle before the collision. Ballow argued that the lack of a slow-moving vehicle emblem made no difference regarding the cause of the collision and showed that the tractor trailer would have still struck the backhoe regardless. The case settled one week before trial for $425,000.
