Plaintiff was driving in Lancaster, New York. His vehicle was struck in the rear by a trailing leased vehicle that was being driven by one defendant, and registered to another defendant's employer. Mr. Ballow managed to keep all of the defendants in the case including the finance company.
Plaintiff sustained a disc herniation at L5-S1. The injury produced cauda equina syndrome, organ dysfunction, and sensory difficulties that are caused by compression of nerve roots that occupy the lumbar spine region. He underwent a microdiscectomy, which is the surgical removal of an intervertebral disc, but his condition ultimately necessitated fusion of three levels of his spine's lumbar region.
Plaintiff suffered residual impairment of several bodily functions and residual footdrop (muscle weakness or paralysis that causes downward drooping of the front portion of a foot).
About two months before the scheduled trial, Mr. Ballow secured a $4.5 million settlement offer which the plaintiff chose to accept.
