The plaintiff, a 40-year-old truck driver, was driving his motorcycle when he was struck by a van operated by the defendant. Defendant failed to yield the right of way which caused the collision. Following the collision, Lindke was taken to Genesee Memorial Hospital which, according to Ballow, failed to administer steroids to stop the swelling of the spinal cord injury. It was also claimed that the defendants failed to properly and adequately immobilize his spinal column which enhanced and worsened the injury he suffered in the collision. Lindke suffered incomplete quadriplegia. After a six-week trial, a jury in 1993 returned a verdict for $1,572,500 which was one of the largest verdicts ever returned in Genesee County.
