Ballow was ready to prove that the defendant obstetricians "dating of the pregnancy" was improper, and it caused Ms. Noga to not deliver until the 43rd week of pregnancy. Ballow assembled experts which would have testified that the defendants failed to provide Noga with appropriate obstetrical testing and surveillance. At time of birth, Noga passed thick meconium, and the electronic fetal monitoring strips indicated that the child was undergoing severe fetal distress. This child suffered severe brain damage resulting from fetal distress, also known as hypoxic ischemic encephalopathy. She suffers with spastic quadriplegia and cerebral palsy.
A Supplemental Needs Trust was established which protects the infant's rights to be maintained in a fully-staffed state-of-the-art facility that provides Noga with all her needs. The amount awarded to Noga is used to supplement her needs as appropriate in attempts to give her some quality of life which she is so deserving of.
