Plaintiff was fatally injured when a front end loader used in a municipal facility was negligently operated and backed over him causing his injuries and wrongful death. The defendants had failed to properly equip the machine for safety, and had failed to properly train their employees in operating this equipment safely.
Defendants claimed that the Plaintiff died instantly, Mr. Ballow found and hired two of the best forensic pathologists in the country (medical specialists Michael Baden M.D., and Bernard Ng M.D.) as experts to prove that the plaintiff consciously suffered as he bled to death. Conscious pain and suffering is a major element in determining the amount of a settlement in a death case.
By so doing Mr. Ballow managed to secure a settlement offer of $2,325,000 which the plaintiffs decided to accept.
