This action settled during jury selection for $175,000 plus a waiver of the $58,000 Workers' Compensation Lien. The plaintiff was a 71-year-old Key Bank employee who slipped and fell on an oily substance as she was walking across a black slate floor at work. Clearview was advised by Key Bank employees in the past to clean the floor with only water but, on the day the plaintiff fell, the floor was shiny, oily and slippery. Ballow was ready to produce a floor maintenance expert who would have testified that a black slate floor cannot be made to look shiny by using water only and that some type of cleaning solution or wax was more likely being used by the defendant. The plaintiff suffered a fractured left hip requiring a partial hip replacement.
