Ken White, a 24-year-old logger operating a log skidder manufactured by the defendant suffered a leg injury when the skidder rolled back onto his leg after he had set the emergency brake. Ballow was ready to show at trial that there were at least four other incidents concerning this model log skidder manufactured by Timberjack that had rolled back when the parking brake system had failed. After 17 surgeries, White had his leg surgically amputated. Two days before trial, the case settled for $2,270,000 which included a waiver of the Workers' Compensation Lien of $400,000.
